Opvolging toezegging over inbreukverboden en proportionaliteit in het octrooirecht

BRIEF VAN DE MINISTER VAN ECONOMISCHE ZAKEN EN KLIMAAT

Aan de Voorzitter van de Tweede Kamer der Staten-Generaal - Den Haag, 20 juni 2022

Concreet hebben de leden van het CDA gevraagd hoe ik sta tegenover het opnemen van een proportionaliteitstoets in de Rijksoctrooiwet 1995. Ik zie hiervoor op dit moment geen aanleiding. Belangrijkste reden hiervoor is dat Nederlandse rechters nu al een afweging kunnen maken of een inbreukverbod proportioneel is en dat in de praktijk ook doen. Het bestaande wettelijk kader biedt hiervoor de nodige flexibiliteit. Het biedt de Nederlandse rechter onder meer de ruimte om invulling te geven aan de jurisprudentie van het Hof van Justitie van de Europese Unie. Ook zijn er geen indicaties dat er sprake is van een ongelijk speelveld met Duitsland en België. Het Eengemaakt Octrooigerecht, dat naar verwachting spoedig van start zal gaan, kan in de nabije toekomst bovendien gaan bijdragen aan verdere uniformering van het octrooiprocesrecht. Het bestaande kader van de Rijksoctrooiwet 1995 biedt de Nederlandse rechter de nodige ruimte ook daarop in te kunnen spelen.

More work needed to improve public access to UPC patent case documents

Last month a law firm submitted a request for documents under rule 262.1 (b) of the UPC Rules of Procedure, which ensures that written pleadings and evidence in patent litigation proceedings are available to the public “upon reasoned request.” The firm is calling on the central division of the Unified Patent Court in Munich to make available all written pleadings and evidence for a pending case in the court. The aim of the law firm, Mathys & Squire, is to establish a clear and consistent path for the public to access these documents in the future. IP2Innovate fully supports this initiative. We have been campaigning for more transparency in patent litigation for many years, and welcomed the improvement to the status quo that the UPC’s rules promised.

Professor Ansgar Ohly is one of Germany’s most respected law professors and an authority on intellectual property law across Europe. He is the Chair for Civil Law, Intellectual Property and Competition Law at the University of Munich. He is also a visiting professor at Oxford University.
